Regarding the development of land on Luiseño Traditional Territory in Southern California

This case study describes negotiations and consultations between the Pechango Tribe in Southern California and the City of Murrieta Hills regarding the development of land on Luiseño Traditional Territory.
Tribal concerns over the environmental and cultural impacts of the project have persisted for decades. Consultation with the city eventually led to an agreement that included input from the Tribe on the handling of cultural resources and identification of items with Tribal cultural value.
The authors aimed to show the importance of good-faith consultation with Tribes regarding land-use projects that may affect areas of important Tribal cultural value and of acknowledging the importance and validity of Tribal knowledge.
The case study includes a history of the development plans and the dispute, descriptions of environmental impacts on traditional cultural places and traditional tribal cultural places, Tribal concerns regarding the consultation, and key testimony from members of the tribe.

This case study, conducted November 2022 through August 2023, addresses the treatment of Pechanga cultural places and resources in the context of a series of consultations that took place under SB 18 and pre-AB 52 CEQA regarding the Murrietta Hills Specific Plan Amendment to develop land within Luiseño Traditional Territory. It identifies several issues related to consultation between Pechanga and the City of Murrieta Hills. These include the weight given to Tribal information about cultural resources in the environmental evaluation, the quality and extent of consultation between the City and the Tribe, and the extent to which the proposed mitigation measures were effective in protecting cultural resources.
