Investigation of rescission practices in the individual health insurance market and their impact on consumers
The objective of this project is to conduct five state-level case studies regarding implementation of the Health Insurance Privacy and Accountability Act (HIPAA) renewability protections. This analysis will help explain the complicated federal-state relationship regarding rescission protection laws and whether HIPAA protections are adequate and being enforced by states. In addition, this analysis will identify best practices that exist in states to protect consumers and develop recommendations for federal and state regulatory reforms to strengthen consumer protections. Harbage Consulting will conduct a series of interviews with state and federal regulators, advocates, and insurance industry officials in each of the five states. The states will be chosen in consultation with Karen Pollitz, who will serve as a consultant and strategic advisor, and the Foundation to ensure a diverse group of states. Criteria will include states with and without strong regulatory infrastructures, large and small states (population or size), as well as geographic and political diversity. The key deliverable will be an analysis of the experience with state implementation of HIPAA rescission protections in five states.
