Under this contract, the Robert Wood Johnson Foundation is commissioning a legal memorandum on whether the federal constitutional issues pending in the U.S. Supreme Court regarding the minimum-coverage requirement (the mandate) of the Affordable Care Act are relevant to the states' legislative authority to enact such provisions. The purpose of this project is to anticipate the possibility that states may argue that if the court finds the federal insurance mandate unconstitutional, states would be precluded, as a matter of U.S. constitutional law, from adopting and enforcing their own such requirement. Patricia Millett, a constitutional expert and seasoned Supreme Court litigator, will prepare the memorandum. The project deliverable will be a single 5- to 7-page memorandum.
